(e) Kahle v. Ashcroft

All old game console games

originally submitted by AnonymousGameFan:

In recent years, writing emulators for old game consoles has become more and more popular. This is because many people like to play the games of their youth but no longer have the systems or the games to play them on (or because the systems/games are so old that they no longer work). The problem is that all old console games are still under copyright, and so people are unable to legally use the ROMS of these games on the emulators. Most of the older games are no longer being sold, and no publisher releases or sells the ROMS for people interested buying them.

This is frustrating for many reasons, and prevents myself (and many others) from being able to legally play many of these games that we can no longer play by other means (due to no longer owning a working version of the original console or game etc). That really only leaves one other option - to violate copyright and find somewhere to download game ROMS on the internet. This is not a choice that I like doing, but with the state of the system at the moment, there is no other alternative.

Anyway, I wish to remain anonymous, but it's not too difficult to find information regarding this topic on the internet.

Stifled uses

AnonymousGameFan:

All I want to do is be able to enjoy playing some of the old computer games that I used to play as a kid. The games and systems are no longer available, and so game console emulators provide a great way of doing this. I wouldn't mind paying a small fee to be able to download the ROMS of games I'm interested in, but no publisher currently allows this. So instead I'm left to violate copyright and download ROMS from the internet.
