(e) Kahle v. Ashcroft

Amiga ROM Kernel Manuals

originally submitted by Sebastien Boisvert:

These technical manuals describe the APIs and how to program the Amiga line of computers.

Stifled uses

Sebastien Boisvert:

These manuals were no longer printed by the publisher and no longer available as an order item anywhere. The manuals are essential to be able to write code for the Amiga line of computers. Because I could not obtain a copy legally (even though a digital format was also available), I could not write programs for this computer, short of illegally obtaining a copy by copying it.

I don't believe that copyright holders should be allowed to bring about copyright infringment suits when they do not provide a legal access to their works (either through direct sale or a license) when there is a clear demand for it, and should not be able to claim 'lost sales' on "infringing copies" when the product was no longer made available for sale when copies for it were still in demand.
